Former Governor of Kaduna State, Nasir El-Rufai

The Independent Corrupt Practices and Other Related Offences Commission (ICPC) has opposed a fresh application for bail filed by former Kaduna State governor, Nasir El-Rufai, in an ongoing case before the Kaduna State High Court.

The development was disclosed in a statement on Tuesday by the Head of Media and Public Communications Unit of the Commission, Okor Odey, following proceedings at the court.

At the resumed hearing, defence counsel, Mr Ubong Akpang, informed the court that a new bail application had been filed, stressing that the matter concerns the personal liberty of his client. He added that all relevant processes had been submitted and served, indicating readiness to proceed.

However, counsel to the ICPC, Mr Ibrahim Mukhtar, told the court that he had just been served with the defendant’s further affidavit in support of the application and would require time to study the documents.

Consequently, the presiding judge, D.H. Khobo, adjourned the matter to May 13, 2026, for hearing of the bail application.

The Commission maintained its opposition to the request, having already filed a counter-affidavit challenging the grounds presented by the defence.

The court had earlier denied bail to El-Rufai in a previous application, citing several concerns raised by the prosecution. Justice Khobo held that the defendant failed to respond to new issues introduced in the ICPC’s counter-affidavit, including allegations of possible flight risk due to his influence and resources.

Other concerns highlighted by the prosecution included alleged obstruction during an attempted arrest at the Nnamdi Azikiwe International Airport, refusal to surrender travel documents and electronic devices, as well as the likelihood of interference with witnesses and evidence.

In its earlier ruling, the court emphasised that bail remains discretionary and must align with the interests of justice. It also noted that the defendant’s status could potentially affect ongoing investigations, particularly as some suspects linked to the case were yet to be apprehended.

The judge further dismissed health-related claims presented by the defence for lack of sufficient evidence and ruled that the defendant should remain in ICPC custody pending the commencement of trial, while directing that the case be heard expeditiously.

Despite the earlier setback, the defence proceeded to file a fresh bail application, prompting the Commission’s latest response opposing the request.

The ICPC reiterated its commitment to due process and the diligent prosecution of corruption-related cases.

“The Commission remains committed to ensuring that justice is served in accordance with the law,” the statement said.
